Terms and Conditions
 
This agreement (the "Agreement") is between you (the "Registrant") and the Double Happiness Gift Registry of Double Happiness Group Limited, ("DH"), and shall constitute the entire and complete agreement between you and DH in connection with this registry service (the "Service"). By accepting and using the Service, you agree to be bound by all of the terms and conditions set forth herewith:


1. REGISTRY SETUP
The Registrant may set up a gift registry by submitting a registry application on-line through our website or offline by contacting us on (852)2529 8213.


2. CUSTOMIZED REGISTRY
Once an application is submitted and accepted, DH shall create a set of personalized web pages containing information submitted by the Registrant and shall make it available for viewing on the internet by visitors by the Guests. The web pages shall include a gift list containing a list of selected gifts (the "Gift List"), an online event RSVP service and an online email registry service. Guests may search for the friend's registry from the DH website, or by contacting DH by phone, fax or email.


3. FEES
There is no charge to the registrants for using our gift registry service. Guests also do not pay any added fees on top of the retail price listed for each gift.
Fees do apply for custom sourced or custom listed gifts which are not from our own website selections or our partner merchants.


4. ADDING GIFTS
The Registrant may add gifts to their Registry in the following ways:


*Registrants select gifts from partner merchants' shops.
(1) Download a gift selection form for each merchant you select gifts from.
(2) Bring the form with you to visit the partner merchant's shop.
(3) Select the items you'd like to list, and ask a shop assistant to help you fill out the item numbers and other item information on the form.
(4) Fax the forms back to us at 2893 7337 for us to upload to your personal registry page, OR you may enter the gifts yourself in the "My Gift List" section of the Registry.

Please note that this process takes between 3-5 working days generally for gift information to be confirmed, before appearing live on your registry.


*Registrants select gifts from our online gift selections
Just click the "Add to my registry" button next to the gift items and the item will be added to your registry and will appear live on your registry right away.



*Registrants select gifts from your imagination.
Contact us to help you source or list directly a gift that you think up. Additional surcharge of up to 12.5% of the retail price may be added to the listed registry price charged to guests for custom sourced or listed gifts. There is no charge to the registrants.


*Registrants may select to receive cash gifts
less an administration fee of 12.5 % from the cash amount given by the guests. Cash gifts must be entered from using the "To Add Cash Gift" section of your registry page.


5. GIFT SELECTIONS FROM PARTNER MERCHANTS
The following conditions apply to gift selections from merchants:
*Discontinued items from partner merchants shops may not be registered due to unstable stock situation.

*The regular retail shop price shall be used on the registry listing, regardless of any special promotions or discounts which may be offered in the shop at the time of gift selection.

*In some cases, gifts may also be selected from a merchant's catalogue or website, in addition to or in lieu of selecting items from the physical shop.


6. GIFTS PURCHASING
Once the Registry is set up and gifts added, a Guest can log in to the Registry, view the Gift List Registry and purchase a gift using a number of payment options, including credit card charge, direct transfer to our multi-currency bank account, or cheque in Hong Kong Dollars. After the purchase transaction has been completed and confirmed, the Gift List shall be automatically updated to avoid duplicate gifts. Once a gift has been purchased, DH shall order the gift from the merchant according to the procedures outlined below ("Processing Gift Purchases").


7. PARTIAL CONTRIBUTION
Registrants have the option to choose the partial contribution function for gifts with retail value over $2,000 HKD. Guests may enter any amount of contribution towards this gift. When the full amount has been paid for, DH shall order the gift from the merchant according to the procedures outlined below ("Processing Gift Purchases").


8. INCOMPLETE PARTIAL CONTRIBUTION PURCHASES
In the event the full amount of a gift with a partial contribution option is not purchased in full by the time of the delivery date, the Registrant may choose to:
(1) make up the difference themselves to complete the gift purchase
(2) convert the Incomplete Partial Contribute amount to a gift certificate or credit from the same partner merchant in the amount already contributed.
(3) choose items of an equivalent amount from any other partner merchant.
(4) take a cash rebate for the value of those gifts, less our 12.5% admin fee.



9. PROCESSING GIFT PURCHASES
Unless a gift item has been marked as a HOLD item (see "HOLD OPTION" below), once we receive a purchase from the Guest for an item, we shall place the order with the merchant. The merchant shall then arrange stock for delivery on or around the "approximate delivery date of gifts" as specified by the registrant if items are in stock or orderable.

Registrants should note that partner merchants' stock levels will fluctuate from time to time and Double Happiness and our parter merchants will not guarantee any stock availability for any item listed on any registry or shown on our website.

If the item is out of stock or discontinued or otherwise unavailable, the registrant may choose to use that gift amount as credit in any of our partner shops. Cash refund may also be opted for, less our 12.5% admin fee.

For any "must have" items, we suggest prepayment in advance for the gift item, the value of which would be reimbursed upon purchase from our registry by guests of the registrants. In the event that this prepaid for gift is not bought from the registry, no further reimbursement or refund shall be made by Double Happiness, and the gift is deemed to have been purchased by the registrants.

For purchases from our online catalogue, please note that stock is also subject to fluctuation. We do not guarantee ready stock of any item in our online offerings. If an item is not available after ordering, the following options are available:
1. full refund may be made to the original purchaser
2. credit in the equivalent purchase amount can be used towards gifts from any of our partner merchants' products or any online product from Double Happiness
3. cash rebate, less 12.5% admin fee made to the registrant (if registrant is different than the gift giver)


10. PROCESSING GIFT PURCHASES (CUSTOM ORDER/INDENT ITEMS)
If a gift is a special order or custom order item, and the item is not a HOLD item (see "HOLD OPTION"below), the merchant shall require final confirmation from the registrants before ordering.


11. HOLD OPTION
At the time of listing a gift item on the Gift List, a registrant will have the choice of HOLDING any gift item. (The Guests shall not see whether an item is on HOLD or not.) In the event a gift item is put on HOLD, DH will still accept purchases for that item, however, the order shall not be placed with the merchant until instructions are received from the registrant to proceed with the order.

If the registrant decides not to proceed with the order (i.e. doesn't want the gift), the registrant may:
(1) use the same amount to select gifts from any other partner merchant
(2) convert a maximum of 25% of the total value of the registry to cash, less an administrative fee of 12.5%.

** If the registrant intends to receive all cash, gift items should be entered from the "Cash gifts" section. If merchant gifts are entered as gifts, only a maximum of 25% of the total value of the registry may be remitted in cash. The remaining 75% value of the registry must be in gift selections from our partner merchants, or custom sourced gifts.

If there is no HOLD option selected for a gift item, the order will be placed with the merchant upon receipt of payment from the guest.


12. DH RETURN AND EXCHANGE POLICY

(1) On custom order/indent items:
Once an order has been placed with the merchant for a custom order or indent gift item, the gift shall not be returnable or exchangeable, except in extraordinary circumstances if agreed to by the merchant.
(2) Gifts which have arrived defective or broken upon delivery shall be replaced by the merchant.
(3) Once a gift item has been sent to the merchant for processing, there shall be no cash refund, unless as outlined in the specific circumstances above.
(4) DH's return and exchange policy shall supercede all partner merchant's return and exchange policies, until after delivery of the gift has been made.
(5) Once a gift has been delivered to the registrant, all matters pertaining to exchanges, warranties, defects and replacements on products shall be settled between the registrant and the merchant directly, according to the merchant's own such policies.



13. CASH GIFTS
If a registrant selects to receive cash gifts or cash rebate from their registry, an administrative fee of 12.5% shall be deducted from the cash total received from guests. The registrant may choose to receive cash in maximum of two payments at any time in the registry process. For more than two cash payments per registrant, bank processing fees will apply in the amount of $100 HKD per payment and shall be deducted by DH before issuing payment. Cash payments shall be issued by cheque and sent by post to the registrant within 14 days upon request from the registrant.


14. DELIVERY OF GIFTS
Gifts will be delivered complementary for registries with paid purchase value of over $3,500 HKD.

Gifts shall be delivered at a time/s mutually convenient to the registrant and DH to any HK Island or selected Kowloon destinations complementary one delivery per merchant brand.

Delivery to other locations, including N.T. and outlying islands, or multiple deliveries may be subject to additional charge. Gifts shall be properly packed in boxes or protective material as appropriate to the gift item, but shall not be gift wrapped, unless by special request in advance. There may be a charge for gift wrapping.

The gifts may be delivered by separate merchants, or by a single merchant, depending on the gifts purchased. Double Happiness will endeavor to group together all deliveries within a single time period, but in some cases, deliveries may have to arranged on different days.

In order for Double Happiness to arrange deliveries, registrants should close their registry or inform us by email that they wish to take delivery of their gifts. Please note that the date you entered on your registration gift selection forms is indicative only and we require you to close the registry, fill out the delivery request on your webpage, OR inform us by email to confirm actual delivery date. We will cut off ordering 10 days prior to the requested delivery date for the single complementary delivery. For any subsequent purchases from the registry, delivery shall be additional charge or registrants may choose to self- pick up from the shops.

For single orders, delivery charge is additional. The local delivery charge is shown when checking out, and covers delivery to any HK Island or selected Kowloon destinations. Delivery to N.T. or outlying islands to be quoted upon request.
For overseas deliveries, please request the delivery charge in the checkout section.

15. TERMINATION
Either party may terminate this agreement immediately with or without cause by closing the registry. Neither party shall be liable to each other or any third party for termination of this agreement and the Service.

In the event of termination, any gifts purchased from the registry to date of termination will be ordered and delivered as per above normal registry terms and conditions, or cash rebate given, as per clause 13 of this agreement.


16. PHOTOS
DH reserves the right to remove any pictures it considers inappropriate which have been submitted by the registrant for their gift list homepage.


17. MODIFICATION TO THE AGREEMENT
DH reserves the right to make modifications to the Agreement from time to time without notice. The most current version of the Agreement shall be accessible on our website at all times. Continued use of the Registry shall constitute agreement to the modified terms of the Agreement.


18. LAWFUL CONDUCT
DH reserves the right to close any registry it feels is inappropriate or inconsistent with its business objectives.


19. INDEMNIFICATION
The Registrant agrees to indemnify and hold DH, its subsidiaries, affiliates, officers and employees and partner merchants, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the use of the Service.


20. WEBLINKS
This web site may contain links to other websites as reference for gift products only. DH has no control over these websites and shall not be responsible for any content on such websites, nor any loss suffered in relation to the use of such websites. The Registrant waives any and all claims against DH, its directors, employees or other representatives regarding the inclusion of links to outside websites or the use of those websites.


21. PRIVACY
DH shall not share the Registrant's personal information with advertisers or any other third party without permission, and will do its best to safeguard personal information from unauthorized access. However, DH shall not be liable for any damages, actual or consequential, that may result from unauthorized disclosure of personal information.


22. WAIVER
The waiver by either party of a breach of any provision of this agreement by the other party shall not be construed as a waiver of any subsequent breach by such other party.


23. PRICING
All product and price information is supplied without liability at the time of registration of gifts. All errors and modifications subject to change without prior notice. While Double Happiness endeavors to do its best to update its pricing accordingly with merchants' pricing levels, there are occasions where there may be price changes discrepancies. In such case the difference in pricing should be paid by the registrants before delivery of gifts made. If the registrant prefers not to proceed with the order, the same options are availble as in #9.

24. SEVERABILITY
If any part of this agreement is invalid or unenforceable under any applicable law, such event shall not render invalid or unenforceable the remainder of this agreement.


25. In event of discrepancy between the English and Chinese versions of these terms and conditions, the English version shall prevail.
